These Terms & Conditions (“Terms”) govern your access to and use of Clearelay’s website, products, and services (collectively, the “Services”). By using the Services, you agree to these Terms.

Using the Services

You may use the Services only in compliance with these Terms and applicable law. You are responsible for information submitted through your account and for keeping your account credentials secure. You may not use the Services to send unlawful, deceptive, abusive, or unsolicited communications.

SMS messaging program

Clearelay may send account, service, support, appointment, and other operational updates by SMS to people who have expressly opted in to receive them. Message frequency varies based on your interaction with Clearelay and the services you use.

• Consent to receive SMS messages is not a condition of purchasing any goods or services.
• Message and data rates may apply.
• You can opt out at any time by replying STOP. After you opt out, you may receive one final confirmation message.
• For help, reply HELP or email support@clearelay.com.
• Carriers are not liable for delayed or undelivered messages.

SMS consent is collected separately from any other consent. By opting in through a Clearelay form, you agree to receive the specific SMS messages described next to that form. Our handling of mobile information is described in our Privacy Policy.

Intellectual property

Clearelay and its licensors retain all rights, title, and interest in the Services, including their software, designs, text, trademarks, and other content. These Terms do not grant you ownership of any Clearelay intellectual property.

Disclaimers and limitation of liability

The Services are provided on an “as is” and “as available” basis to the extent permitted by law. Clearelay does not guarantee that the Services will be uninterrupted, secure, or error-free. To the maximum extent permitted by law, Clearelay will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services.

Changes and termination

We may change the Services or these Terms from time to time. The revised Terms will be posted on this page with a new effective date. We may suspend or terminate access to the Services if these Terms are violated or where reasonably necessary to protect the Services, users, or others.
